1 Appellant, George Meeks, hereinafter referred to as defendant, was charged, tried and convicted in the District Court, Wagoner County, Case No. CRF-74-39, for the offense of Rape in the First Degree, in violation of 21 O.S. 1971 § 1114 [21-1114]. His punishment was fixed at a term of five (5) years in the State penitentiary and from said judgment and sentence, a timely appeal has been perfected to this Court.
